  7. License Agreement and Warranty Disclaimer

  9. You should carefully read the following terms and conditions before using
  10. this software. Use of this software indicates your acceptance of these terms
  11. and conditions. If you do not agree with them, do not use the software.

  14. Non-registered Version
  15.  
  16. The Non-registered Version of E! for Windows is a version on which the
  17. Registration procedure has not been applied. To run the registration
  18. procedure you need a registration code which will be sent to you after
  19. payment. This procedure disables the reminder dialog box and allows you to
  20. disable the CRC checking feature of E!.
  21.  
  22. You are hereby licensed to: use the Non-registered Version of the software
  23. for a 60-day evaluation period; make as many copies of the Non-registered
  24. Version of this software and documentation as you wish; give exact copies of
  25. the original installation diskette to anyone; and distribute the
  26. Non-registered Version of the software and documentation in its unmodified
  27. form via electronic means. There is no charge for any of the above.

  29. You are specifically prohibited from charging, or requesting donations, for
  30. any such copies, however made and from distributing the software and/or
  31. documentation with other products (commercial or otherwise) without prior
  32. written permission, with one exception: Disk Vendors are permitted to
  33. redistribute E! for Windows, subject to the conditions in this license and
  34. in the limited licence detailed in VENDOR.TXT without specific written
  35. permission.

  37. However, Disk Vendors are not allowed to charge more than $5 (or its
  38. equivalent in their local currency) for a disk containing the Non-registered
  39. Version of E! for Windows. Moreover, E! for Windows may not be distributed
  40. on diskettes containing other products, even in compressed form unless
  41. instructions are given describing how to build an installation diskette from
  42. the distributed disk.

  44. Unregistered use of E! for Windows after the 60-day evaluation period is in
  45. violation of federal and european copyright laws.

  48. Registered Version

  50. The registered version of E! for Windows as well as the API documentation
  51. may not be distributed/uploaded in any form and for any reason by
  52. individuals or Disk Vendors. Violations of this agreement will be
  53. prosecuted.

  56. Evaluation and Registration
  57.  
  58. This is not free software. This license allows you to use this software for
  59. evaluation purposes without charge for a period of 60 days. If you use this
  60. software after the 60-day evaluation period a registration fee is required
  61. (please see ORDER.FRM). Payments must be in US dollars or in german Marks
  62. (DM) and should be sent to the address mentioned in ORDER.FRM. Credit card
  63. ordering and quantity discounts are available.

  65. When payment is received you will be sent a registered copy of the latest
  66. version of E! for Windows, a printed documentation and the E! for Windows
  67. API documentation. You will also benefit from a fax hot-line service at the
  68. following fax number in Germany:

  76. Your registration code will be valid for all future versions of E! for
  77. Windows (unless a major change occurs, in which case information will be
  78. given on how to receive a new registration code).

  80. One registered copy of E! for Windows may be dedicated to a single person
  81. who uses the software on one or more computers or to a single workstation
  82. used by multiple people.

  84. You may access the registered version of E! for Windows through a network,
  85. provided that you have obtained individual licenses for the software
  86. covering all workstations that will access the software through the network.
  87. However, E! for Windows has not been tested with all networks, so we cannot
  88. guarantee that this will be possible in all cases.

  91. Governing Law

  93. This agreement shall be governed by the German law.

  96. Disclaimer of Warranty

  98. This software and the accompanying files are sold "as is" and without
  99. warranties as to performance of merchantability or any other warranties
  100. whether expressed or implied. In particular, there is no warranty for the
  101. optional virus scanning (CRC verification) feature. Because of the various
  102. hardware and software environments into which E! for Windows may be put, no
  103. warranty of fitness for a particular purpose is offered.

  105. The user must assume the entire risk of using the program. Any liability of
  106. the seller will be limited exclusively to product replacement or refund of
  107. purchase price.
